  • Kansas and Wichita quick takes: Sunday April 10, 2011

    Local elections, qualifications of Wichita’s elected officials. On today’s edition of the KAKE Television public affairs program This Week in Kansas, Wichita State University’s Ken Ciboski, Chapman Rackaway of Fort Hays State University and myself join host Tim Brown to discuss local elections in Kansas. Mention was made of a recent article I wrote that was critical of the educational attainment of some Wichita City Council members. See Education gap on Wichita City Council.

    Steineger, Kansas senator, to address Pachyderms. This Friday (April 15) Kansas Senator Chris Steineger will speak to the members and guests of the Wichita Pachyderm Club on the topic “Using Business Principles to Restructure State and Local Government For Long-Term Efficiency.” Steineger, of Kansas City, has served in the Kansas Senate since 1997 and in December switched his affiliation from the Democratic to Republican party. Steineger has voted with Republicans on fiscal issues for many years. Explaining why he switched parties, he wrote “I am a fiscal hawk who believes Americans have been borrowing, spending, and living beyond their means for too long.” Steineger has spoken at events organized by Americans for Prosperity.

    Washington Monument strategy. At about 11:00 pm Friday night, President Barack Obama spoke on television in front of a window where the Washington Monument could be seen in the background. He said that thanks to the just-struck agreement to continue funding the operations of the federal government, the monument would be open to visitors the next day. This is explicit use of the Washington Monument strategy, in which the response to any proposed cut or slowdown in the growth of government is illustrated in the most painful or visible way. As the Wikipedia entry states: “The most visible and most appreciated service that is provided by that entity is the first to be put on the chopping block.” … The president also said “I would not have made these cuts in better circumstances.”

    Soros conference online. This weekend’s conference of the Institute for New Economic thinking has quite a few papers and videos online at the conference’s website. Surprise: Keynes and his economic theories are revered. Attendees are treated to papers and presentations like this: “It is the interdependence between the rule of law and the production and distribution of goods and services that gives capitalism its unity. The autonomy of the economy is thus an illusion, as is its ability to self-regulate. And we are in the current mess because the scales have tipped slightly too far in favour of this illusion. This shift in the balance represents an inversion of values. Efficiency, it was believed, would be better served if the workings of governments were regulated more tightly (especially in Europe, although the theory originates in America) and if the markets were deregulated to a greater extent. The ingenuity of the financial markets initially, then their blind sightedness, did the rest.” … What?

    Economics in one lesson this Monday. On Monday (April 11), four videos based on Henry Hazlitt’s class work Economics in One Lesson will be shown in Wichita. The four topics included in Monday’s presentation will be The Lesson, The Broken Window, Public Works Means Taxes, and Credit Diverts Production. The event is Monday (April 11) at 7:00 pm to 8:30 pm at the Lionel D. Alford Library located at 3447 S. Meridian in Wichita. The library is just north of the I-235 exit on Meridian.     Wichita City Council this week. On Tuesday, the Wichita City Council considers only consent agenda items. Then, tributes — including video — to outgoing Council Members Paul Gray, Sue Schlapp, and Roger Smith and installation of new members. A new vice mayor will also be selected. … I don’t know if the city will be hosting a luncheon afterward. Two years ago a celebratory luncheon titled “Wichita City Council Changing of the Guard” cost over $1,000.

  • Education gap on Wichita City Council

    Before Jim Skelton left the council in January, none of the four men serving on the Wichita City Council had completed a college degree. The three women serving on the council set a better example, with all three holding college degrees.

    Of the candidates running in next week’s election for four council seats and the office of mayor, less than half hold college degrees.

    Is it necessary to complete college in order to serve in an office like mayor or city council? Apparently none of the four men who held these offices without a degree thought so. The two running to retain their present positions — Mayor Carl Brewer and council member Jeff Longwell (district 5, west and northwest Wichita) — evidently don’t think so, or they would not be running again.

    But we tell young people that college holds the key to success. We encourage schoolchildren to consider college and to take a rigorous high school curriculum in order to prepare for it. We encourage families to save for college. Our region’s economic development agency promotes the number of people with college or advanced degrees. We promote our colleges and universities as a factor that distinguishes Wichita. We hope that our elected officials will set an example we want young people to follow.

    Once in office, we ask our city elected officials to attempt to grasp and understand complex sets of financial data, working with a budget of about half a billion dollars for the City of Wichita. We hope that they will be able to consider large and weighty issues such as the role of government in a free society. Members of the professional management staff — bureaucrats — that manage the city, county, and state are generally required to hold college degrees.

    The irony is that elected officials often are highly reliant on the bureaucratic staff for information, data, and advice, and this professional bureaucracy is often highly educated. Does this imbalance create problems?

    Elected officials compared to regular people

    Amazingly, it turns out that elected officials, as a group, are less knowledgeable about civics than the general population. That’s the finding of Intercollegiate Studies Institute, which surveyed Americans and their knowledge of civics in 2008. After analyzing the data, ISI concluded: “Simply put, the more you know about American government, history, and economics the less likely you are to pursue and win elective office.”

  • Kansas and Wichita quick takes: Monday March 21, 2011

    Wichita City Council this week. As it is the fourth Tuesday of the month, the Wichita City Council handles consent agenda items only and often has a workshop. Consent agenda items are thought by the agenda-builder to be non-controversial, and are voted on by the council as a group, unless a council member requests to pull an item for individual discussion and voting. … This week’s meeting will also feature the awarding of a key to the city to Kansas Governor Sam Brownback. Perhaps the governor will take a moment to comment on his economic development plan, which discourages the type of targeted incentives that Wichita relies on. … The agenda packet is at 03-22-2011 Council Agenda Packet.

    Government the problem. Rasmussen: “Ronald Reagan famously declared in his first inaugural address in January 1981 that ‘government is not the solution to our problem; government is the problem.’ Forty-six percent (46%) of Likely U.S. Voters tell us in a new national telephone survey that that policy position is held mostly by conservatives and 40% say Reagan’s view is shared by most Americans.” The poll finds “Just 19% of the Political Class believe Reagan’s view is shared by most Americans.” The political class is the minority of voters who believe in big government. Rasmussen says they “tend to trust political leaders more than the public at large and are far less skeptical about government.” The Wall Street Journal has more on this at Populism and the Political Class.

    Budget worse than thought. “The Congressional Budget Office on Friday released its analysis of President Obama’s 2012 budget proposal and found it does less to rein in deficits and the debt than the administration had estimated.” A large share of the blame is placed on the extension of the Bush-era tax cuts.     Detroit turns schools over to charters. From Education Week: “The financially embattled Detroit school system has announced a controversial plan to turn nearly a third of the district’s 141 schools over to charter operators or education-management organizations by next school year. Officials say their only other option is to close dozens of low-performing schools. If the plan to hand 41 schools over to outside managers is approved by the school board, the 73,000-student Detroit district will be borrowing a page from the same playbook that a growing number of large urban districts seem to be using.” … The article notes that Philadelphia turned over seven schools to charter operators, and Los Angeles will turn over seven next year. Charter schools are funded by public money but operate largely outside the existing public school system. They usually have wide latitude in setting policies, and generally the teachers union is not involved. Not everyone thinks the plan will work, with one critic writing “Chartering schools is not a silver bullet that can solve the long-standing governance, financial, and academic issues that districts like Detroit face.” … Kansas has few charter schools as Kansas law is designed to ensure that few charters will be granted.

    The State and the Intellectuals. Murray N. Rothbard asks the question “Why do people obey the edicts and depredations of the ruling elite?” and provides the answer. From For a New Liberty: The Libertarian Manifesto: The answer is that, since the early origins of the State, its rulers have always turned, as a necessary bolster to their rule, to an alliance with society’s class of intellectuals. The masses do not create their own abstract ideas, or indeed think through these ideas independently; they follow passively the ideas adopted and promulgated by the body of intellectuals, who become the effective “opinion moulders” in society. And since it is precisely a moulding of opinion on behalf of the rulers that the State almost desperately needs, this forms a firm basis for the age-old alliance of the intellectuals and the ruling classes of the State. The alliance is based on a quid pro quo: on the one hand, the intellectuals spread among the masses the idea that the State and its rulers are wise, good, sometimes divine, and at the very least inevitable and better than any conceivable alternatives. In return for this panoply of ideology, the State incorporates the intellectuals as part of the ruling elite, granting them power, status, prestige, and material security. Furthermore, intellectuals are needed to staff the bureaucracy and to “plan” the economy and society. … In the modern era, when theocratic arguments have lost much of their lustre among the public, the intellectuals have posed as the scientific cadre of “experts” and have been busy informing the hapless public that political affairs, foreign and domestic, are much too complex for the average person to bother his head about. Only the State and its corps of intellectual experts, planners, scientists, economists, and “national security managers” can possibly hope to deal with these problems. The role of the masses, even in “democracies,” is to ratify and assent to the decisions of their knowledgeable rulers.

  • In Kansas schools, follow the money

    When the Kansas Policy Institute found that Kansas schools were sitting on large unspent fund balances, the initial reaction of school bureaucrats is that these balances were an illusion — they didn’t exist. Then the schools admitted that the balances existed, but contended that they couldn’t be spent in a way that would help schools make it through a few tough budget years. Now it’s apparent that Kansas public schools simply don’t want to spend the money they’ve saved — money that was given to schools for educating children but wasn’t spent for that purpose. Instead, they’d rather ask for tax increases and sue the state’s taxpayers.     Kansas public schools hold cash while threatening cuts

    If someone told you public school districts are talking about closing schools and firing teachers because of funding challenges, but aren’t using millions in cash they built up over the last few years, you’d probably say “that can’t be true.” But it’s happening in Kansas.

    Districts began this year with $1.6 billion in unencumbered carryover cash reserves. “Unencumbered” means the cash is not subject to any lien, encumbrance or other creditor claims. Some cash comes from property tax levies and must be spent accordingly, such as for capital projects and debt service. But even subtracting that money plus federal funds and a few small amounts that can’t be touched according to state legal authorities, Kansas school districts still had $742 million in other operating funds.

    That’s an average of $1,633 per-pupil in cash. Governor Brownback’s proposed 2012 budget increases state aid but non-returning federal stimulus aid would result in a net loss per-pupil of about $232, or 1.9% of combined state, federal and local funding. With the average district having seven times that amount in carryover reserves, one would think most districts would say they could cover the difference and still be able to increase spending by using a portion of their reserves. Some plan to do so. Many others, with more than adequate reserves, say they will be “forced” to lay off teachers and take other drastic steps.

    The cash is held in dozens of funds, some of which have statutory restrictions on how fund balances can be used. Still, the state department of education says districts can access some restricted reserve balances by simply not transferring as much in as needs to be spent. Legislators could and should lift transfer restrictions so schools can use their reserves as needed.

    The vast majority of that $742 million represents state and local tax dollars given to schools in prior years for education purposes that instead were used to increase cash reserves. The total increased by $306 over the last five years, going from $436 million to $742 million.

    School funds operate on a cash basis just like your personal checkbook; the balances only increase if more is deposited than is spent. Since Kansas school districts added $306 million to their cash reserves over the last five years, one might ask if this would be a good time to use some of that money as originally intended.

    The projected decline in total aid next year is about $106 million, so schools would only have to use about 14 percent of their carryover cash to hold funding steady. Using cash reserves isn’t a long term solution but there’s plenty there to allow time to find other solutions, including operating more efficiently. Independent audits have disclosed tremendous savings opportunities. Kansas public schools spent an average of $12,330 per-pupil last year. That was down 2.6 percent from the previous year but still a 27 percent increase over the previous five years.

    One legitimate reason schools give for holding cash is that Kansas has not always made school aid payments on time as a result of recession-driven revenue declines. The state is working to resolve that problem by trying to reduce spending.

    Another reason is likely related to a new lawsuit filed by a group of school districts, contending the state is not meeting its constitutional funding obligation. A 2005 Kansas Supreme Court ruling in Montoy vs. State of Kansas ordered the Legislature to spend an additional $853 million on K-12 education. The Legislature complied with the court’s ruling and that case was closed. But the recession forced state aid to decline in 2010. Total state aid has since increased but is not back to previously-scheduled levels. So now some districts are using taxpayer money intended for educational purposes to sue the state again.

    Here’s the conundrum districts face regarding the use of their carryover cash reserves. How can they contend they are under-funded if $306 million of the aid received since the last lawsuit was used to increase cash reserves? Holding on to their cash build-up might help their lawsuit, but it certainly doesn’t help students or the teachers who are being laid off.

    School districts need some degree of carryover reserves but it should be determined how much can be made available and take whatever steps are necessary to put it to work in schools. It makes no sense to raise taxes or let teachers go when there are tax dollars sitting the bank.

  • Kansas and Wichita quick takes: Sunday March 13, 2011

    Wichita city council this week. There is no meeting of the Wichita City Council this week, as most members will be attending a meeting of the National League of Cities in Washington, DC. These conferences are designed to help council members be more effective. But for three of the council members that will be attending, their future service on the council is measured in days, not years. These three lame duck members — Sue Schlapp, Paul Gray, and Roger Smith — will be leaving the council in April when their terms end. Their participation in this conference, at taxpayer expense, is nothing more than a junket — for lame ducks.

    How attitudes can differ. At a recent forum of city council candidates, one candidate mentioned the five or six police officers conducting security screening of visitors seeking to enter Wichita city hall, recognizing that this doesn’t create a welcoming atmosphere for citizens. Vice Mayor Jeff Longwell said he thought the officers are “accommodating and welcoming.” It should be noted that Longwell carries a card that allows him to effortlessly enter city hall through turnstiles that bypass the screening that citizens endure. Further, it’s natural that the police officers are deferential to Longwell, just as most employees are to their bosses. … This attitude of Longwell is an example of just how removed elected officials can be from the citizens — and reality, too. Coupled with the closing of the city hall parking garage to citizens and the junket for lame ducks described above, the people of Wichita sense city hall elected officials and bureaucrats becoming increasingly removed from the concerns of the average person.

    Private property and the price system. In The Science of Success, Charles Koch succinctly explains the importance of private property and prices to market economies and prosperity, how government planning can’t benefit from these factors, and the tragedy of the commons: “Private property is essential for both a market economy and prosperity. There cannot be a market economy without private property, and a society without private property cannot have prosperity. To ensure ongoing innovation in satisfying people’s needs, there must be a robust and evolving system of private property rights. Without a market system based on private property, no one can know how to effectively allocate resources. This is because they lack the information that comes from market prices. Those prices depend on voluntary exchanges by owners of private property. Prices and the resulting profit and loss guide entrepreneurs toward satisfying the needs of consumers. Through this system, consumers are able to direct entrepreneurs in efficiently allocating resources through knowledge and incentives in a way no central authority can. … The biggest problems in society have occurred in those areas thought to be best controlled in common: the atmosphere, bodies of water, air, streets, the body politic and human virtue. They all reflect aspects of the ‘tragedy of the commons’ and function much better when methods are devised to give them characteristics of private property.”

    Toward a free market in education. From The Objective Standard: “More and more Americans are coming to recognize the superiority of private schools over government-run or ‘public’ schools. Accordingly, many Americans are looking for ways to transform our government-laden education system into a thriving free market. As the laws of economics dictate, and as the better economists have demonstrated, under a free market the quality of education would soar, the range of options would expand, competition would abound, and prices would plummet. The question is: How do we get there from here?” Read more at Toward a Free Market in Education: School Vouchers or Tax Credits?. … This week in Kansas a committee will hold a hearing on HB 2367, known as the Kansas Education Liberty Act. This bill would implement a system of tax credits to support school choice, much like explained in the article.

    Are lottery tickets like a state-owned casino? This week a committee in the Kansas House of Representatives will hear testimony regarding HB 2340, which would, according to its fiscal note, “exempt from the statewide smoking ban any bar that is authorized to sell lottery tickets under the Kansas Lottery Act.” The reasoning is that since the statewide smoking ban doesn’t apply to casinos because it would lessen revenue flowing to the state from gaming, the state ought to allow smoking where lottery tickets are sold, as they too generate revenue for the state.

    Money, Banking and the Federal Reserve. This month’s meeting of the Wichita chapter of Americans for Prosperity, Kansas features a DVD presentation from the Ludwig von Mises Institute titled “Money, Banking and the Federal Reserve.” About the presentation: “Thomas Jefferson and Andrew Jackson understood “The Monster.” But to most Americans today, Federal Reserve is just a name on the dollar bill. They have no idea of what the central bank does to the economy, or to their own economic lives; of how and why it was founded and operates; or of the sound money and banking that could end the statism, inflation, and business cycles that the Fed generates.” The event is Monday (March 14) at 7:00 pm to 8:30 pm at the Lionel D.     Wichita-area legislators to meet public. Saturday (March 19th) members of the South-Central Kansas Legislative Delegation will meet with the public. The meeting will be at Derby City Hall, 611 Mulberry Road (click for map), starting at 9:00 am. Generally these meetings last for two hours. Then on April 23 — right before the “wrap-up session” — there will be another meeting at the Wichita State University Hughes Metropolitan Complex, 5015 E. 29th Street (at Oliver).

    Pompeo to meet with public. If you don’t get your fill of politics for the day after the meeting with state legislators, come meet with United States Representative Mike Pompeo, who is just completing two months in office. Pompeo will be holding a town hall meeting at Maize City Hall, 10100 W. Grady (click for map) starting at 1:00 pm on Saturday March 19th.

    Losing the brains race. Veronique de Rugy writing in Reason: “In November the Organization for Economic Cooperation and Development (OECD) released its Program for International Student Assessment scores, measuring educational achievement in 65 countries. The results are depressingly familiar: While students in many developed nations have been learning more and more over time, American 15-year-olds are stuck in the middle of the pack in many fundamental areas, including reading and math. Yet the United States is near the top in education spending.” … A solution is to introduce competition through markets in education: “Because of the lack of competition in the K–12 education system. Schooling in the United States is still based largely on residency; students remain tied to the neighborhood school regardless of how bad its performance may be. … With no need to convince students and parents to stay, schools in most districts lack the incentive to serve student needs or differentiate their product. To make matters worse, this lack of competition continues at the school level, where teacher hiring and firing decisions are stubbornly divorced from student performance, tied instead to funding levels and tenure.” The author notes that wealthy families already have school choice, as they can afford private schools or can afford to move to areas with public schools they think are better than the schools in most urban districts.

    Teachers unions explained. A supporter of the teachers unions is questioned about her belief that the unions need more money and power. In Kansas, the teachers union in the form of Kansas National Education Association (KNEA) and its affiliates consistently opposes any attempt at reform.

  • Kansas and Wichita quick takes: Wednesday March 9, 2011

    Kansas legislature website. It’s getting better, and now has — by my recollection — all the functionality of the site it replaced. But there are still some issues. The search feature uses a Google site-specific search, which is good in many ways. But trying to find if there’s any legislation this year concerning sales tax? Not so easy. … The rosters of members are displayed in panels of 12 members of a time. For the House there are 11 such panels. I wonder on which panel I’ll find the member I’m looking for? … Too many documents are still being delivered in OpenOffice doc format, which many people will not be able to use.

    Kansas smoking ban. The Hutchinson News has reported and editorialized on the statewide smoking ban. In Hutch club owner wants to see measure repealed, Sheila Martin expresses her concern for the small business owners who are being harmed by the smoking ban. The booklet Martin created that the article refers to may be read here Kansas Smoking Ban Booklet. Then the newspaper editorialized against the smoking ban, writing “Eight months since it took effect, the local jury is in on Kansas’ statewide smoking law. It has hurt sales at some drinking establishments — no doubt, in turn, hurting state and local sales tax receipts — and it was doubtful that it stopped anyone from smoking or saved many from exposure to secondhand smoke.”

    Fighting government secrecy. Announcing a television show regarding government transparency, the Kansas Sunshine Coalition for Open Government writes: “Open government is essential to a democracy. But it’s often hard to find that vital government transparency — and to get public access to public records, even when the law is on your side. “What is your government hiding?” is the focus of a town hall panel set at 4:00 to 5:00 pm Saturday, March 12, at the First United Methodist Church, 330 N. Broadway, in downtown Wichita. The event will be taped and shown on KAKE-TV and affiliated stations around the state at 10 am Sunday, March 13, as part of the national celebration of Sunshine Week (March 13-19). … ‘The Mike and Mike Show’ will headline the meeting. Media attorney Mike Merriam of Topeka will join University of Kansas law professor Mike Kautsch in a interactive presentation on media law, as well as how citizens can use the Kansas Open Records Act and the Kansas Open Meetings Act. … The show also will feature a panel on the importance of open government led by the League of Women Voters of Wichita. The audience is invited to ask questions. Refreshments will be available at a reception afterward. …KPTS-TV, Channel 8 in Wichita, will rebroadcast the show at 7 pm, Thursday, March 24. Those interested are asked to arrive in time to be seated by 3:45 pm. The event is sponsored by the Kansas Sunshine Coalition, the LWV and the Elliott School of Communication at Wichita State University.

    Kansas judicial selection. The Wall Street Journal takes notice of the need for judicial selection reform in Kansas, writing “Kansas is the only state that gives the members of its bar a majority on the judicial nominating commission. That commission also handles the nominations for state Supreme Court justices, and changing that would require a state constitutional amendment. The Sunflower State is nonetheless off to a good start at making judicial appointments more than a preserve of the lawyers guild.” … Kansas University Law Professor Stephen J. Ware is the foremost authority on the method of judicial selection in Kansas and the need for reform. His paper on this topic is Selection to the Kansas Supreme Court, which is published by the Federalist Society for Law and Public Policy Studies.     Kansas Education Liberty Act. A strong school choice measure has been introduced in the Kansas House of Representatives. The bill is HB 2367 and may be read at the Kansas Legislature website. The measure’s supporters have a website at supportkela.com. From the bill’s supporters: “This bill authorizes specific non-profit organizations to grant scholarships to students to attend a qualified private or public school of their parents’ choice. These scholarships are funded through tax-credit eligible contributions from individual Kansans and corporations. State taxpayers will spend significantly less on each scholarship than they currently spend per pupil in public schools. This bill reduces education related spending from the state’s general fund and reduces the budget deficit. In addition, public schools will still have access to the majority of the federal and local taxpayer funding; so with each student who chooses another educational setting, public schools will have more funding per remaining student. Perhaps even more significant, our children will enjoy improved education outcomes in both public and private education in the state of Kansas with increased parental and community involvement.” … While the Kansas education establishment fiddles with “reforms” such as whether to grant tenure in three or five years, actual reform measures like this are what is needed.

    What … it’s not about the whales? “Environmental policy is not driven by tree-hugging activists, earnest liberal bloggers, or ecologically minded citizens. Instead, it flows from the lobbyists and executives of well-connected multinational corporations and built-for-subsidy startups that see profit in the loan guarantees, handouts, mandates, and tax credits Congress creates in the name of saving the planet.” Timothy P.     Wichita council candidates. Now that the city primary election is over and each district has two candidates for the April 5 general election, this week’s meeting (March 11) of the Wichita Pachyderm Club features Wichita City Council candidates. Invited are from district 2: Pete Meitzner and Charlie Stevens. From district 4: Joshua Blick and Michael O’Donnell. From district 5: Jeff Longwell and Lynda Tyler.     Common Sense — Revisited author in Wichita. Clyde Cleveland will visit Wichita to speak at the Holiday Inn at 549 S. Rock Road on Wednesday, March 16th at 7:00 pm. The event’s promotional poster reads: “Join Clyde Cleveland, the author of Common Sense — Revisited and 2002 libertarian candidate for Iowa Governor for an eye-opening presentation on our Government and how we can restore it to the Republic in its original form.   • KNEA, the Kansas teachers union, open to reform?

    Do the teachers unions in Kansas, particularly Kansas National Education Association (KNEA), have the best interests of schoolchildren as their primary goal? Are teachers unions open to change and reform?

    An op-ed written by Claudette Johns, who is executive director for KNEA, claims that the union is open to new ideas, and that the goal of the union is “to make public schools great for every child.” But when we look at what teachers unions in Kansas actually do, we see that the unions are a roadblock to better schools.

    There are many ways that teachers unions work against the interests of children. For example, the contract for teachers in USD 259, the Wichita public school district, provides for two ways for teachers to earn a higher salary (besides taking on extra duties like coaching): they can teach more years, and they can gain additional education credentials.

    There are several problems with this approach to teacher pay. First, there is compelling research that indicates that beyond the first few years, additional years of experience contribute nothing to teacher effectiveness in the classroom, with one exception.

    As to gaining extra education: “The evidence is conclusive that master’s degrees do not make teachers more effective,” according to a summary of research prepared by the National Council on Teacher Quality. Amazingly, some studies have found that as teachers gained more credentials, their effectiveness in the classroom declined. Yet, the contract negotiated by the Wichita teachers union — and most unions across the country — requires that districts pay teachers more as they gain these credentials which do nothing to increase effectiveness.

    Even if you discount these studies, are we to believe that all teachers increase in effectiveness in lockstep as they advance in seniority and gaining additional training? Of course not. But the teachers union contract says this is the way teachers are to be paid. Effectiveness in the classroom — which is what children need — is not a consideration.

    The teachers unions have created a system where teaching effectiveness — how well someone does their job — means nothing as to how much teachers will be paid. That’s important, as we are becoming aware that there is a very large difference in the learning experiences of students based on teacher effectiveness. Even President Obama recognizes the absurdity of this situation, and he and Department of Education Secretary Arne Duncan have advocated merit pay. This is a system where teachers are evaluated on their effectiveness and paid accordingly, just like almost all private sector workers are paid and rewarded.

    But the teachers union will vigorously oppose any efforts to implement anything that smells like merit pay. It’s one of the union’s most important reasons for existing, and it perpetuates a system that drives motivated teachers out of the schools.

    Another important goal of teachers unions is to protect the policy of granting tenure, after which it is virtually impossible to fire a teacher for poor effectiveness. This is another teachers union policy that works against teacher effectiveness and student learning. In Kansas, the teachers union strongly opposes changing the probationary period before the granting of tenure from three to five years.

    The teachers union, when it promotes these policies, has an argument on their side that has some validity. It is said that school administrators — in a system without tenure and rigid salary schedules — would practice “crony” hiring and promotion practices. They would reward their friends and family and punish their enemies or those they simply don’t like.

    These things happen in a system insulated from market competition, and institutions don’t suffer when they do. In the private sector, when a manager makes staffing decisions based on cronyism — rather than hiring and retaining the best possible employees — the profitability of the company suffers. If managers’ compensation is tied to profitability, they suffer when making staffing decisions based on cronyism rather than merit. The company could perform so poorly that it goes out of business.

    A system of market competition, however, forces each institution — schools, too — to be the best they can possibly be. When schools compete for students and funding, principals might learn to like, promote, and reward their very best teachers.

    School administrators also might learn how to evaluate and recognize the best teachers. This is vitally important, because of the factors under the control of schools, teacher quality is by far the most important factor in student success. It’s much more important than class size, which is another thing teachers unions constantly advocate for.

    The merits of this argument don’t mean that we should have teachers unions that operate more like industrial unions than a group representing workers that seek to be treated as professionals. Instead, it means we need more ways to hold school administrators accountable for the actions, and in turn, teachers. The best way to do this is to introduce market competition through various forms of school choice. Charter schools in Kansas would be a good start. But school choice and market competition is another reform the teachers unions oppose — again putting their own interests first.

  • Kansas and Wichita quick takes: Monday January 31, 2011

    Some downtown Wichita properties plummet in value. A strategy of Real Development — the “Minnesota Guys” — in Wichita has been to develop and sell floors of downtown office buildings as condominiums. Some of these floors have been foreclosed upon and have come back on the market. Some once carried mortgages of $400,000 or more, meaning that at one point a bank thought they were worth at least that much. But now four floors in the Broadway Plaza Building, three floors of the Petroleum Building, two floors of Sutton Place, and one floor of the Orpheum Office Center are available for sale at prices not much over $100,000, ranging from $14 to $25 per square foot. Other downtown office buildings — very plain properties — are listed at much higher prices. For example, one downtown property is listed at $82 per square foot. … Some of these floors have had declining appraisals. According to the Sedgwick County Treasurer, the fifth floor of Sutton Place, which is listed for sale at $135,000, was appraised in 2008 for $530,900. In 2009 the appraised value dropped to $215,000.

    Kansas Days. The primary news made at this year’s Kansas Days gathering was the election of Todd Tiahrt to replace Mike Pompeo as national committeeman. Otherwise, there was a large turnout in Topeka with many receptions and meals that provided opportunities to meet officeholders and new friends, and to reacquaint with old friends from across the state. Plus, I got to sample the “Brownback” beer. It’s pretty good.

    Williams named to national economic development committee. From Wichita Business Journal: “Wichita City Council member Lavonta Williams has been named to a National League of Cities steering committee on Community and Economic Development Policy and Advocacy.” Undoubtedly for her unfailing support of any form of corporate welfare that comes before the Wichita City Council.

    Mises University this summer.     A Rosa Parks moment for education. Kevin Huffman in the Washington Post: “Last week, 40-year-old Ohio mother Kelley Williams-Bolar was released after serving nine days in jail on a felony conviction for tampering with records. Williams-Bolar’s offense? Lying about her address so her two daughters, zoned to the lousy Akron city schools, could attend better schools in the neighboring Copley-Fairlawn district. … In this country, if you are middle or upper class, you have school choice. You can, and probably do, choose your home based on the quality of local schools. Or you can opt out of the system by scraping together the funds for a parochial school. But if you are poor, you’re out of luck, subject to the generally anti-choice bureaucracy.” Kansas has no school choice programs to speak of, and so far Kansas Governor Sam Brownback has not expressed advocacy for school choice.

    The state against blacks. The Wall Street Journal’s Jason L. Riley interviews economist Walter E. Williams on the occasion of the publication of his most recent book Up from the Projects: An Autobiography. The reason for the article’s title: “‘The welfare state has done to black Americans what slavery couldn’t do, what Jim Crow couldn’t do, what the harshest racism couldn’t do,’ Mr. Williams says. ‘And that is to destroy the black family.’” … On economics and why it is important, Riley writes: “Over the decades, Mr. Williams’s writings have sought to highlight ‘the moral superiority of individual liberty and free markets,’ as he puts it. ‘I try to write so that economics is understandable to the ordinary person without an economics background.’ His motivation? ‘I think it’s important for people to understand the ideas of scarcity and decision-making in everyday life so that they won’t be ripped off by politicians,’ he says. ‘Politicians exploit economic illiteracy.’” … On the current state of politics: “Mr. Williams says he hopes that the tea party has staying power, but ‘liberty and limited government is the unusual state of human affairs. The normal state throughout mankind’s history is for him to be subject to arbitrary abuse and control by government..”

    Professor Cornpone. From The Wall Street Journal Review & Outlook: “The last time these columns were lambasted by a presidential candidate in Iowa, he was Democrat Richard Gephardt and the year was 1988. The Missouri populist won the state caucuses in part on the rallying cry that ‘we’ve got to stop listening to the editorial writers and the establishment,’ especially about ethanol and trade. Imagine our amusement to find Republican Newt Gingrich joining such company. The former Speaker blew through Des Moines last Tuesday for the Renewable Fuels Association summit, and his keynote speech to the ethanol lobby was as pious a tribute to the fuel made from corn and tax dollars as we’ve ever heard. Mr. Gingrich explained that ‘the big-city attacks’ on ethanol subsidies are really attempts to deny prosperity to rural America … Yet today this now-mature industry enjoys far more than cash handouts, including tariffs on foreign competitors and a mandate to buy its product. Supporters are always inventing new reasons for these dispensations, like carbon benefits (nonexistent, according to the greens and most scientific evidence) and replacing foreign oil (imports are up). … Given that Mr. Gingrich aspires to be President, his ethanol lobbying raises larger questions about his convictions and judgment.” Another advocate for the ethanol boondoggle, and perhaps again a presidential candidate, is Kansas Governor Sam Brownback.

    Politics and city managers to be topic. This Friday (February 4) the Wichita Pachyderm Club features as its speaker H. Edward Flentje, Professor at the Hugo Wall School of Urban and Public Affairs, Wichita State University.   • Kansas school teacher cuts

    As Kansas struggles with its budget and decides what to do with public schools, advocates of public school spending exaggerate claims of pending job cuts and fail to take advantage of an opportunity to improve our state’s base of teachers.

    Misinformation about school employment is plentiful. An article from the Hutchinson News (Budget cuts a way of life for Kansas school districts, December 26, 2010) is typical: “More than 1,000 teachers and 900 classified school employees have been cut out of the system.”

    The Kansas State Department of Education surveyed school districts asking how many positions were reduced or eliminated due to lack of funding for the 2009-2010 school year. The answer was 1,160 teachers.

    Actual employment figures from the KSDE indicate that for the 2008-2009 school year, Kansas schools employed 35,438 teachers. For 2009-2010 34,985 teachers were employed. That’s a drop of 453 teachers, or quite a bit less than half of the 1,160 teachers schools said they would have to cut.

    Looking at total employment, schools claimed they would have to cut 3,704 jobs. The actual number of jobs lost was 562.

    We see that the public schools, like many government agencies, exaggerate the effects of spending cuts — or even a slowdown in the rate of growth of spending. Whether this exaggeration is purposeful and dishonest is for others to decide. But this tendency is something to keep in mind as school districts across the state tell taxpayers and legislators what the effect of reduced school funding will be.

    Cuts could be beneficial

    While schools don’t like to see employment cuts, especially for teachers, cuts could be used to beneficial effect if not for the rules that most school districts have adopted. These union work rules require that teachers be laid off in order of seniority. Therefore, the teachers with the longest service will be the last to be let go.

    It might seem like retaining the most experienced teachers is a beneficial policy. But research tells us that longevity in the classroom is not related to teacher effectiveness. One study found results that are typical: “There appear to be important gains in teaching quality in the first year of experience and smaller gains over the next few career years. However, there is little evidence that improvements continue after the first three years.”

    Another result: “Thus we conclude that novice teachers in the sample are less effective than teachers in the sample with some experience, but beyond the first couple of years, more experienced teachers are no more effective than those with a couple of years of experience.”

    So when school districts retain their most experienced teachers, they are making a decision to keep their most highly-paid teachers, using reasoning that has found not to hold up in the real world. This causes stress on school budgets for something that doesn’t improve student learning.

    If Kansas schools would lay off their most ineffective teachers first, that would improve the overall quality of teachers in Kansas schools. But Kansas has weak policies in place to determine which teachers are effective.

    Instead, Kansas schools will inform parents that class sizes will get larger. That might be true. But we now know it’s much better for a child to be in a large class with an effective teacher than to be in a small class with an ineffective teacher. But the policies of Kansas schools will not let this improvement in teacher quality take place.

    Is it all about the kids?

    Kansans ought to ask who the public schools serve. The schools, of course, say it’s all about the kids. But when the schools have work rules that protect the most expensive teachers when these teachers are not the most effective based solely on longevity, we see that the public schools are like most government programs: they exist to protect themselves, not their customers (students) and funders (taxpayers).
